TERMS AND CONDITIONS FOR MYDRIVER PASSENGER AUSTRALIA PTY LTD RIDESHARE SERVICES

1. Introduction

Welcome to MyDriver Australia Pty Ltd (“MyDriver”, “we”, “us”, or “our”). These Terms and Conditions (“Terms”) govern your access to and use of our rideshare services, mobile application, and website (collectively, the “Services”).

By accessing or using the Services, you agree to be bound by these Terms.

2. Compliance with Australian Law

These Terms are governed by the laws of the Commonwealth of Australia and the State or Territory in which the Services are provided. Nothing in these Terms excludes, restricts, or modifies any rights you may have under the Competition and Consumer Act 2010 (Cth), including the Australian Consumer Law (ACL).

3. Eligibility

You must be at least 18 years old to use the Services. By using the Services, you confirm that you have the legal capacity to enter into a legally binding agreement.

4. Nature of Services

MyDriver provides a technology platform that connects passengers (“Riders”) with independent third-party drivers (“Drivers”).

MyDriver is not a transportation provider.
Drivers are independent contractors and not employees, agents, or partners of MyDriver.
MyDriver does not guarantee the availability, suitability, or quality of transportation services.

5. User Accounts

You must register an account to use the Services.
You agree to provide accurate, current, and complete information.
You are responsible for safeguarding your login credentials.
You are responsible for all activity conducted under your account.

6. Bookings and Pricing

Fares are calculated based on time, distance, demand, location, tolls, and other relevant factors.
All prices are displayed in Australian Dollars (AUD) and include GST unless stated otherwise.
You authorise MyDriver to charge your selected payment method upon completion of the ride.

7. Payments

Payments must be made via the MyDriver platform using approved payment methods.
You agree to pay all applicable fees, including booking fees, tolls, cleaning fees, and cancellation fees where applicable.
Invoices or receipts will be provided electronically.

8. Cancellations and Refunds

Riders may cancel a booking; cancellation fees may apply depending on timing and driver allocation.
Drivers may cancel rides where reasonable (e.g., safety concerns or rider misconduct).
Refunds will be provided in accordance with Australian Consumer Law.
Nothing in this section limits your rights under the ACL.

9. Driver Obligations

Drivers using the platform must:

Hold a valid Australian driver licence appropriate for rideshare services.
Comply with all applicable state and territory rideshare regulations.
Maintain all required registrations, permits, and insurance (including compulsory third party insurance).
Ensure their vehicle is safe, roadworthy, and clean.

10. Rider Obligations

Riders agree to:

Behave respectfully toward Drivers and others.
Not engage in unlawful, abusive, violent, or disruptive behaviour.
Not damage vehicles or property.
Comply with all applicable laws and safety requirements (e.g., wearing seatbelts).

11. Safety Disclaimer

While MyDriver takes reasonable steps to promote safety:

We do not guarantee the safety, reliability, or quality of any ride.
You use the Services at your own risk, subject to your rights under the ACL.

12. Liability

To the maximum extent permitted by law:

MyDriver excludes all liability for indirect, incidental, or consequential loss.
MyDriver is not liable for acts or omissions of Drivers or Riders.

However:

Nothing in these Terms excludes or limits liability for guarantees that cannot be excluded under the Australian Consumer Law.
Where liability cannot be excluded, it is limited (at our option) to resupplying the Services or the cost of resupply.

13. Insurance

Drivers are responsible for maintaining all legally required insurance.
MyDriver may maintain additional insurance policies where required by law, but does not guarantee coverage for all incidents.

14. Ratings and User Feedback

Riders and Drivers may rate each other.
MyDriver may suspend or deactivate accounts based on poor ratings, complaints, or breaches of these Terms.

15. Prohibited Conduct

You must not:

Use the Services for unlawful purposes.
Harass, threaten, or harm others.
Interfere with or disrupt the platform.
Provide false or misleading information.

16. Account Suspension or Termination

We may suspend or terminate your account immediately if:

You breach these Terms;
You pose a safety risk; or
Required by law or regulatory authorities.

17. Privacy

We collect, use, and disclose personal information in accordance with the Privacy Act 1988 (Cth) and our Privacy Policy.

18. Intellectual Property

All content, branding, software, and materials associated with the Services are owned by or licensed to MyDriver. You must not reproduce or use them without prior written consent.

19. Dispute Resolution

If a dispute arises:

You agree to first contact us to attempt to resolve the issue in good faith.
If unresolved, disputes may be referred to mediation.
You may also lodge complaints with relevant consumer protection bodies in your State or Territory.

20. Governing Law

These Terms are governed by the laws of the State or Territory in which the Services are provided, and the Commonwealth of Australia. You submit to the non-exclusive jurisdiction of Australian courts.

21. Changes to Terms

We may update these Terms from time to time. We will provide notice where required by law. Continued use of the Services constitutes acceptance of the updated Terms.

23. Entire Agreement

These Terms constitute the entire agreement between you and MyDriver regarding the Services and supersede any prior agreements.

By using MyDriver Australia Services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.
